Terms and Conditions
When you book with Big Day in Key West (BDKW) , you agree to the terms and conditions listed below, without modification. We may update the terms and conditions of use from time to time.
1. The Client will pay a non-refundable retainer deposit to secure wedding date and time . Deposits paid to BDKW will be deducted from total amount. The deposit payment is non-refundable under any circumstances.
2. PAYMENT REQUIREMENTS:
In full consideration of all services listed in agreement with BDKW, the Client agrees to pay BDKW the full amount of services 1 month prior to the event execution date if paying via credit card or electronic funds transfer.
3. WEATHER BACK UP
The client is responsible for arranging a suitable option for weather back up locations and adequate time to set up and strike materials required for event. (Generally requires 3 hours to set up and 1 hour to strike). If client has arranged a secondary “rain” plan, BDKW will make every effort to cooperate and set up at secondary location if time allows. BDKW must be given 24 hour notice if location change must occur. Company maintains the right to substitute certain décor depending on theme and space of secondary location.
4. SITE POLICY:
Big Day in Key West Company cannot control an outside environment and will not be held responsible for environments that cause difficulties with site décor such as wind or rain. Company will make every effort to set up the packages purchased but if climate does not allow, the client will be notified. Complete package price will still be valid though certain site options cannot be utilized due to weather. Big Day in Key West maintains the right to substitute certain décor at any time. Company is not responsible for site reservations or permitting unless otherwise specified in duties section. The Arbor sheers decorated as such in picture can’t withstand wind gusts of 25mph. In the event high winds are present, Big Day will supply a back up arbor for the event or restyle sheers on arbor. Big Day reserves the right in the event of inclement weather, such as winds, rain and lighting, to refrain from setting up any prop believed by Big Day to be a safety hazard to guest or subject to damages as a result of such weather. Omitted supplies are not subject to a refund.
5. In the Keys, there are also pop up storms that are not detected by radar. If your wedding will be affected by an imminent weather event - you will be offered the option to reschedule to a date and/or timeline when Big Day company can retain the full package options. YOU can arrange back up place through your hotel, guest house, rental house or reception site to allow an ceremony indoors , we will accommodate that request. There will be no refunds for decor if it is not allowed on the site premises.
6. OVERTIME CHARGES
Additional charges will apply if the Client goes beyond the scheduled event duration for Big Day or any vendor. The beginning and end times will be concretely determined at least 10 days prior to event. If Client goes over any of the time limits, charges will be billed to Client and due within 30 days from billing invoice date.
7. CANCELLATION POLICY
In the event that the Client wishes to cancel the performance or that the performance of this agreement cannot take place through no fault of Big Day, charges may apply. These charges shall be paid as liquidated damages and not as a penalty.
Deposit and Service fees are not refundable under any circumstances.
Reminder: If Client cancels the event for any circumstances within 30 days of the event, full balance on the client’s agreements will be paid to Big Day in Key West.
8. CONDUCT OF EVENT
The client will agree to appropriate conduct during scheduled event. Conduct will be in an orderly manner in compliance with applicable laws and regulations of venue location. Client assumes full responsibility for the conduct of all persons in attendance and for any damages done to any part of a venue’s premises used during said event. All supplies and materials used in set up are considered the property of Big Day in Key West company . Client will be responsible for replacement or repair costs for any items damaged, lost or stolen during the event. As such, Big Day is not responsible for items lost, stolen or damaged that are left in the site belonging to the client or attendants of client.
9. VENDORS AND OTHER OUTSOURCED SERVICES
Big Day in Key West company retains professional service providers such as limo and transportation companies, beauty services, florists and other services. These vendors require deposits to reserve your wedding date. Big Day forwards deposits to these vendors to retain their services. Any deposit paid to a subcontracted vendor is non-refundable.
10 . MARRIAGE LICENSE AND VOWS
Client will obtain their legally issued State Marriage License from appropriate issuing agency. Client should bring the marriage license to the event to give to the Officiate if one is being provided by BDKW. The Officiate will sign and execute the license and comply with State recording requirements of 60 days. Big Day do not responsible for lost of the license, mistakes or other court or Post Office issues.
